Welcome to TeachWhizz. These Terms of Service ("Terms") govern your access to and use of the TeachWhizz website and services (the "Service"). The Service is operated by Etienne Education Ltd ("Teacher", "we", "us", or "our"), a company registered in the United Kingdom.

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.

2. Use of Service

• Eligibility: You must be at least 18 years old to use the Service.
• Account Registration: You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
• Secure Credentials: You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password.

3. User Content and License

• Ownership: You retain full ownership of any worksheets, lesson plans, or other materials you generate or upload using the Service ("User Content").
• License to Us: By creating User Content on TeachWhizz, you grant us a worldwide, non-exclusive, royalty-free license to host, store, transfer, display, perform, reproduce, and distribute your User Content for the purpose of operating and improving the Service.
• Public Library: Unless you explicitly mark your User Content as "Private" (a feature available to varying degrees depending on your subscription tier), you agree that your User Content may be included in our public library, accessible to other users of the Service.
• Prohibited Content: You agree not to upload or generate content that contains personal data of students (PII), is illegal, offensive, or infringes on the intellectual property rights of others.

4. Subscriptions and Payments

Some parts of the Service are billed on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring and periodic basis ("Billing Cycle"). We reserve the right to modify, terminate, or otherwise amend our offered subscription plans at any time.

5. AI-Generated Content Disclaimer

The Service uses artificial intelligence to generate educational materials. AI-generated content may contain inaccuracies or omissions and should not be relied upon without review. You are responsible for reviewing, editing, and validating all content before use in an educational setting.

6. Copyright and Intellectual Property Complaints

TeachWhizz respects the intellectual property rights of others. Users are solely responsible for ensuring that any User Content they create or upload does not infringe third-party rights.

If we receive a valid notice alleging that User Content infringes copyright or other intellectual property rights, we reserve the right to remove or disable access to such content without prior notice.

To submit a copyright or intellectual property complaint, please contact legal@teachwhizz.com with sufficient details to identify the content and the rights allegedly infringed.

7. Limitation of Liability

To the maximum extent permitted by law, in no event shall Etienne Education Ltd, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

8. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.
